DAR to PNP: Comply with the President's order

news reg 1 pix 1 may 16 2017Acting on President Rodrigo Duterte’s instruction, Agrarian Reform Secretary Rafael “Ka Paeng” Mariano reminded the Davao del Norte Police office to assist in the installation of the members of the Madaum Agrarian Reform Beneficiaries Association, Inc. (MARBAI) in the 145-hectare San Isidro (Sanid) Farm in Tagum, Davao del Norte.

Duterte specifically gave the go-ahead to Mariano to proceed with the installation in MARBAI farmers in the disputed area during a farmers’ campout in Mendiola last May 9. 

The President said in vernacular that, “the government promises to grant you the lands you deserve. These lands are yours.” 

Duterte has been vocal in his support for genuine agrarian reform and the leadership of Mariano in DAR.  

On April 18, Mariano requested the assistance from the local police in Tagum to assist in the installation. 

"The Provincial Director of Davao del Norte Police Office is deputized to assist DAR in the enforcement and implementation of the writ of installation,” Mariano said.

However, the installation was halted following the lack of the local PNP’s operational plan and the move of PRO 11 Police Chief Superintendent Manuel Gaerlan to seek clarification from the Regional Trial Court Branch 14 on whether or not the police will assist with DAR’s writ of installation.

Mariano stressed that the lower court has no jurisdiction over the matter because it is DAR who has quasi-judicial powers over agrarian reform concerns.

Citing Section 50 of the Comprehensive Agrarian Reform Law or Republic Act 6657, Mariano said “DAR clearly has quasi-judicial power and exclusive jurisdiction in all issues involving the implementation of the agrarian reform program. Only the Supreme Court may issue a temporary restraining order to stop the implementation of DAR’s decision.”

He added that, “agrarian reform must be supported and defended by the people including the police. This the first step in achieving peace and food security.” 

DAR had earlier issued a writ of installation allowing members of the Madaum Agrarian Reform Beneficiaries Association, Inc. (MARBAI) to claim lands awarded to them in the 145-hectare San Isidro (SANID) farm area.

Mariano said the area claimed by the members of MARBAI is an awarded land under the Comprehensive Agrarian Reform Program (CARP). 

The San Isidro Farm is inside the lands operated by the Lapanday Foods Corporation (LFC).
