DAR-Abra successfully conducts first ever virtual court hearing
INGENUITY is the order of the day, at least for the provincial office of the Department of Agrarian Reform (DAR) in Abra, at this time when the Novel Coronavirus 19 continues to plague the country.
Instead of just sitting down and relax, DAR-Abra provincial agrarian reform adjudicator (PARAD) Atty. Leilani Carmelita R. Magbanua, came up with an ingenious way of hearing agrarian cases without exposing herself, her staff and the parties concerned to the Covid (Coronavirus disease) 19.
The PARAD office serves as the judicial body set up by the DAR in every province to hear agrarian and agrarian-related cases. The office is under the RARAD in every region and the DAR Adjudication Board (DARAB) at the central office.
Dubbed as "Virtual Court Hearing," Magbanua said it would be the "new normal" set up in judicial and quasi-judicial proceedings while waiting for the cure to the virulent virus.
Magbanua explained that the DAR-Abra has been exploring the current advanced information technology to serve justice promptly to their clients.
"We cannot afford to wait until when the antidote against Covid 19 will be discovered. As the saying goes, 'justice delayed, justice denied,'" she stressed.
Magbanua said the virtual court hearing works like the usual court that hears cases where counsels of the two or more contending parties are made to appear through online video conference, unless the court finds the presence of their respective clients unnecessary.
She said the DAR-Abra created official electronic mail (email) account where all parties concerned could submit their electronic filing of petitions, manifestations, evidence, and other legal documents
A messenger group chat account was also created where the virtual court hearings would be conducted through online video conference, she added.
"We already put the virtual court hearing to a test last May 20, 2020 and it proved successful," Magbanua said.

Ang pagiging malikhain ay napapanahon sa ngayon, kahit na sa opisina ng Kagawaran ng Repormang Pansakahan o Department of Agrarian Reform (DAR) sa Abra, habang patuloy na nananalasa ang Novel Corona Virus 19 sa buong bansa.

Ang opisina ng PARAD ang nagsisilbing korte na itinatag ng DAR sa bawat lalawigan upang dinggin ang mga kasong agrayo at iba pang may kinalaman dito. Ito ay nasa ilalim ng RARAD sa bawat Rehiyon at ng DAR Adjudication Board (DARAB) sa central office.
Tinaguriang "Virtual Court Hearing," sinabi ni Magbanua na ito na ang maaaring maging "new normal" para sa pagdinig ng mga judicial at quasi-judicial proceedings habang hinihintay ang gamot sa virus ng Covid-19.
Ipinaliwanag ni Magbanua na ang DAR-Abra ay pinagsisikapang tuklasin ang iba pang paraan gamit ang makabagong teknolohiya upang makatulong sa agarang pagbibigay hustisya sa kanilang mga kliyente.
"Wala tayong panahon para hintayin kung kailan matutuklasan ang gamot laban sa Covid 19. Kawikaan nga: ‘Ang mabagal na pag-usad ng kaso ay nagkakait ng tamang hustisya at nararapat na hatol dito.’ ('justice delayed, justice denied,')" aniya.
Ayon kay Magbanua, ang virtual court hearing ay maihahalintulad sa karaniwang pagdinig ng kaso, kung saan kailangan ang presensiya ng lahat ng mga partido sa mga kaso at ito ay isinasagawa lamang sa pamamagitan ng online video conference, maliban na lamang kung mapagdesisyunan ng korte na ang kanilang presensya ay hindi na kinakailangan.
Binanggit ni Magbanua na ang DAR-Abra ay nagbukas na ng "official electronic mail account” (email) kung saan ang mga partido ng kaso ay maaaring magsumite o magsampa ng mga petisyon, paghahayag, mga ebidensiya at iba pang dokumentong legal sa pamamagitan ng e-filing, aniya.
Nagbukas din ang DAR-Abra ng Messenger group chat account kung saan gaganapin ang pagdinig ng kaso o virtual court hearing gamit ang online video conferencing.
"Sinubukan na namin ang virtual court hearing nuong Mayo 20, 2020 at naging maayos naman ang lahat," ani Atty. Magbanua.
